A New York family is now suing the Department of Education, the city of New York, and a former school teacher after the teacher pled guilty to punching their son.

A surveillance video inside of a school cafeteria caught the whole thing on tape.

It happened in August 2014. The teacher can be seen punching an 11-year-old autistic student who reportedly has the mental capacity of a 6 year old.

The teacher claimed that he was acting in self defense, and the student threw the first punch. However, the teacher pled guilty in April 2015 to misdemeanor assault and was sentenced to anger management classes.

The boy's parents say that the child is now being home schooled because he is too scared to go to school.

The family has filed a $5.5 million lawsuit
