Lawsuit filed against Henderson Police Department

A lawsuit has been filed against Henderson Police because of an incident at Sportsman's Warehouse.

A store employee is claiming that police officers mistook him for a shoplifting suspect, punching and kicking him and using a stun gun on him.

The incident happened last January but the lawsuit was just recently filed.

Lawyers for James Herndon say their client was trying to tell the officers he was not the suspect during the incident.

He suffered fractures and a concussion and was left with bruises.

A spokeswoman for Henderson told the Las Vegas Review-Journal that she was "unaware" of the incident and declined to comment.
