UPDATE FEB. 26: 44-year-old Eric Perry has been arrested and charged with murder after, police say, he shot and killed his brother, Richard Perry.

According to the police report, Las Vegas Metropolitan Police received a 911 call from the mother of the brothers, Janet Clark, at around 9:37 a.m. Tuesday, reporting that Richard had been shot.

Responding officers found Eric Perry standing outside of the apartment complex and he directed them to where the family lived.

Inside the apartment, they discovered the victim unresponsive and suffering from an apparent gunshot wound to the chest.

Richard was transported to UMC Trauma where he eventually succumbed to his injury.

The mother of the two men told detectives that she lived in the apartment with her younger son, Eric.

Her oldest son, Richard, had just been released from prison and had moved in with them.

She said that the two brothers had, in the past, a contentious relationship but, since Richard had been released, they seemed to be getting along.

On the day of the shooting, Janet said that she was getting ready for work and Eric had just returned from his own shift, when she heard the two men arguing over the television.

Soon after, she heard a pop and went out to find Richard lying on the floor in the hallway and unable to say anything.

Janet then called 911.

When detectives then interviewed Eric Perry, he claimed that his mother had called him while he was on his way home from work to tell him that his brother had been shot.

He said that, when he arrived at the apartment, he found Richard lying on the ground and his mother on the phone with 911.

Eric told detectives that he then ran out of the apartment to find the whoever was responsible for shooting his brother but did not find anyone.

Police say that Eric Perry had, prior to the verbal interview, provided them with a written statement as to what occurred but that there were discrepancies between the written statement and what he was now telling them.

For one thing, according to the report, Perry could not say at what point in the timeline he had time to change out of his work clothes.

Detectives also played a recording of the 911 call his mother made where she told the operator that her son had shot her other son.

Janet Perry only has the two sons.

Eric could not account for the inconsistencies nor as to why his mother said he had shot his brother during the 911 call but maintained that he did not shoot his brother.

Based on the problems with his account of what occurred, Eric Perry was taken into custody and charged for the murder of his brother, Richard Perry.

Police searched the apartment and the immediate area outside but have not been able to recover the gun.

They do say that they did find some .22 caliber shells in a drawer inside the apartment that were the same as the one that killed the victim.

Eric Perry made his first appearance in Las Vegas Justice Court on Wednesday morning where he was appointed a public defender.

He will have a bail hearing on Friday.

Anyone with any information on this case is asked to call police at 702-828-3521, or to remain anonymous call Crime Stoppers at 702-385-5555.
