UPDATE: Coroner identifies Vegas man killed trying to stop burglary

UPDATE DEC. 10: The Clark County coroner's office has identified the person killed Sunday as 25-year-old Daniel Garcia III. He died due to a gunshot wound to the abdomen with this death ruled a homicide.

Las Vegas police are investigating a deadly shooting shortly before 6 a.m. Sunday on Shinyleaf Circle, near Charleston and Nellis boulevards, in east Las Vegas.

Police say that Daniel Garcia II heard a noise outside and went outside to investigate. He found a male inside his 2014 Chevy Silverado.

He confronted the man and the two of them got into a scuffle.

The man's son, Daniel Garcia III, came out and approached the two men.

The older man saw a gun wrapped in a blue bandana just before he heard a shot and heard his son yell in pain. He then heard a second shot.

The two men continued to fight and the older man was able to keep the suspect away from the gun until officers arrived.

The younger man in his early 20s was transported to the hospital and pronounced deceased.

The suspected shooter, identified as Benjamin Smith, was treated to a self-inflicted gunshot wound to the leg and facial injuries sustained during the fight.

A .357 caliber revolver was recovered at the scene along with the suspect's identification.

Smith was booked into Clark County Detention Center and is facing charges of murder with a deadly weapon, attempted murder with a deadly weapon, and burglary with a gun.

The coroner has not officially identified the deceased.

On Nov. 30, a 17-year-old was shot in killed in a separate but similar incident in North Las Vegas. Police say he and his father confronted a suspect who stole their truck. The teen who died has been identified as Kevin Soriano.
