A judge set a Sept. 1 preliminary hearing for a 34-year-old man accused of displaying a replica gun and prompting an active shooter response by police at a Las Vegas clothing store.

Las Vegas Justice of the Peace Eric Goodman also appointed public defenders on Friday to represent Jason Lee Mote on robbery, burglary and assault and with a weapon charges.

Mote was arrested Tuesday afternoon at a northwest Las Vegas shopping complex after police say he argued with a woman in a parking lot, and then caused a disturbance in the store with the display of the handgun later found to be fake.

A Nevada Highway Patrol trooper arrested Mote outside the store, and police SWAT officers were summoned before authorities determined there wasn't another gunman in the store.
