A California surrogate mother of triplets is fighting the biological father for custody.

She says the surrogacy contracts are unfair and do not consider the best interest of the children.

48-year-old Melissa Cook is already the mother of four. She says early in the pregnancy the father told her he no longer wanted three babies, saying he couldn't afford all of them.

The father is a 50-year-old single deaf postal worker from Georgia, who is currently living with his parents.

"I want to make sure the children are being taken care of. I love them while they were in me. I love them still", says Cook.

The attorney for the biological father is disputing those claims saying his client asked the woman to abort one of the babies out of concern for "her health and the health of the children."

Now, Melissa is taking her fight to court and is suing.
