Ohio files lawsuit against famous groundhog

(KTNV) -- An Ohio man has had it with the winter weather and he is blaming the famous groundhog Punxsutawney Phil.

Butler County prosecutor Mike Gmoser has had it. Phil didn't see his shadow and that was supposed to mean an early spring.

Thousands gather each year on Gobbler's Knob in Pennsylvania on Feb. 2 to watch the famous groundhog.

It is anything but spring-like in Ohio right now so the prosecutor wants to take Phil to task.

Gmoser filed a fake lawsuit that claims Phil did not see his shadow "purposely, and with prior calculation and design."

Gmoser says Phil is already behind bars serving a life sentence so he thinks that the death penalty is the way to go.

It was all done jokingly, of course. But, Ohioians are definitely fed up with the winter weather.
