(KTNV) -- A nursing home in California is defending one of its nurses who refused pleas by a 911 operator to perform CPR on an elderly woman who later died.

The 911 operator can be heard on the 911 tape released by the Bakersfield Fire Department asking if there is anybody that is willing to help the woman and not let her die.

The nurse on the phone responds "Not at this time."

The nurse had called 911 to request paramedics for the 87-year-old woman who had collapsed in the home's dining room and was barely breathing.

After asking the nurse to help several times, the 911 asks if there is another resident or gardener or anyone willing to get on the phone and receive instructions on how to perform CPR.

Paramedics took the woman to a nearby hospital where she was declared dead.

The nursing home defended the nurse and said that they followed their protocol. A representative for the nursing home also said that resident agree to their policy when they move in.
