NV Supreme court overturns law targeting developer
LAS VEGAS (AP) -- The Nevada Supreme Court has ruled unconstitutional a state law passed a decade ago to prevent the construction of several thousand homes overlooking a desert wilderness area.
The court ruled Thursday in favor of developer Jim Rhodes, who wants to build on Blue Diamond Hill near the Red Rock National Conservation Area.
Rhodes has been fighting since 2003 to construct homes and shopping areas in an area zoned for rural use. Environmentalists and neighbors object.
The court ruled that lawmakers had violated the Nevada Constitution when they passed a law to prevent the development. The ruling says that the restrictions were unconstitutional because the Legislature is not allowed to pass local laws regulating county business.
