Doc's lawyer seeks delay in hepatitis C case
LAS VEGAS (AP) -- Lawyers for a former Las Vegas doctor facing criminal charges in a hepatitis C outbreak in 2007 want a judge to suspend proceedings and determine again whether he's competent for trial.
The Las Vegas Review-Journal reports that Dipak Desai defense attorney Richard Wright filed court documents late Friday saying that a recent psychiatric evaluation raises new doubt about Desai's mental fitness.
Meanwhile, a Nevada Supreme Court panel on Friday tossed out a racketeering charge in the 28-count criminal indictment against Desai and two former clinic employees.
The three justices also ordered a Clark County District Court judge to let prosecutors amend the indictment to clear up language in 14 charges alleging criminal neglect and mistreatment of patients allegedly infected with hepatitis C at Desai's clinic.
