Brothers punished in viral bullying video case
Las Vegas, NV (KTNV) -- A sucker punch caught on camera and uploaded online. The viral bullying video is getting two brothers into trouble.
"I think it's blown out of proportion compared to the many, many, cases," defense attorney Daniel Hastings said. He represents the 15-year old brother seen in the video.
With attorney's at their side, both brothers appeared in court on battery charges. The 15-year-old brother wore yellow, the 13-year-old brother wore orange.
Prosecutors showed the judge the video and said the attack on another boy was planned.
"The video is clear, they started recording prior to any punches being thrown," Deputy District Attorney, Cynthia Herren, said. "This was premeditated, planned - they were going after this young man."
That young man's mother is Elaine Sams. She said her son is doing fine after being the victim of the attack. Sams said he was walking home from school when it happened.
Defense attorney's said the older brother pushed his younger brother to throw the first punch, while someone shot the video on an iPad.
"Bullying or lashing out in a physical way is not appropriate, it's never appropriate," Hastings said. "But my client is not the poster child for bullying."
The judge gave both boys a strict punishment recommended by the probation department. The 15-year-old will go to youth camp, while the younger brother will serve 12-months probation.
"As long as they learned their lesson," Sams said. "And as long as their parents understand they need to keep better control of their kids."
Defense attorney's said the brothers grew up in a household with domestic violence and lashing out is the way they know how to solve problems. The judge ordered counseling for both boys and bullying classes.
