Las Vegas, NV (KTNV) -- Joe Victorino Vazquez -- the man accused of trying to hire a hit man to kill his wife as a birthday present to himself -- appeared in a Las Vegas court this morning.

He wasn't there for long though. Vazquez's preliminary hearing was dismissed because a grand jury is now hearing his case.

Vazquez is facing charges of solicitation to commit murder, conspiracy to commit murder, and burglary.

Police say that he asked a friend for help in finding a hit man because he said his wife was cheating on him.

That friend tipped off police.

He was arrested last month after allegedly paying an undercover cop $2,000 to kill his wife.
