
In the continuing endoscopy center scandal, the Nevada State Board of Medical Examiners has filed a Complaint against a third doctor who worked in the practice of Dr. Dipak Desai.
Clifford Carrol, M.D. is charged with four counts related to his practice at the Endoscopy Center of Southern Nevada.
The four counts are:
(1) Malpractice related to his care of a patient with hepatitis C by failing to assure that other patients under Dr. Carrol's care did not become infected with hepatitis C;
(2) Malpractice in the performance of a colonoscopy on a patient by infecting the patient with hepatitis C which originated with another patient that Dr. Carrol had earlier treated the same day;
(3) Failure to exercise the skill or diligence or use the methods ordinarily exercised under the same circumstances by physicians in good standing practicing in the same specialty or field when a patient contracted hepatitis C that was transmitted to the patient by another patient who was also treated by Dr. Carrol;
(4) Bringing the medical profession into disrepute.
A hearing has been set for June 22, 2009.
Another doctor recently convicted in federal court for giving patients unapproved botox treatments has lost his license to practice medicine.
At an emergency meeting of the Nevada State Board of Medical Examiners, the Board summarily suspended the physician's license of Las Vegas physician Stephen L. Seldon, M.D.
In a Complaint filed against Dr. Seldon on December 1, 2008, the Board's Staff stated three counts against Dr. Seldon:
(1) Conviction of a felony in the United States District Court, District of Nevada, related to his practice of medicine;
(2) Conviction of a felony that constituted a violation of a federal law regulating the possession, distribution or use of any dangerous drug, namely Dr. Seldon's purchase and administration of botulinum neurotoxin type A that was not approved by the FDA for human use;
(3) Failure to exercise the skill or diligence or to use the methods ordinarily exercised under the same circumstances by physicians in good standing practicing in the same specialty or field.
The Board of Medical Examiners found that allowing Dr. Seldon to continue practicing medicine in Nevada while awaiting a hearing on this complaint would endanger the health, safety and welfare of his patients, especially in view of the summary suspension by the Nevada State Board of Pharmacy of Dr. Seldon's controlled substances registration on November 24, 2008.
A hearing has been set for May 4, 2009.
The Board also summarily suspended the controlled substances privileges of Las Vegas physician Randall Foster, M.D.
In a Complaint filed against Dr. Foster on December 1, 2008, the Board's Staff stated three counts against Dr. Foster:
(1) Malpractice regarding the prescribing of controlled substances to four patients;
(2) Failure to maintain accurate and complete medical records regarding his prescribing of controlled substances;
(3) Prescribing controlled substances in violation of applicable law for the treatment of pain.
The Board of Medical Examiners found that the continued exercise of controlled substances privileges by Dr. Foster in Nevada while awaiting a hearing on this complaint would endanger the health, safety and welfare of his patients.
The effect of the Board's summary suspension of Dr. Foster's controlled substances privileges is that Dr. Foster may still practice medicine in Nevada, but he may not prescribe, administer or dispense controlled substances until the Complaint against him is resolved.
A hearing has been set for May 20, 2009.
