Hearing on state malpractice laws

Dozens of patients filled the Grant Sawyer Building today to protest what they say is a law that protects bad doctors.

"They walk into court and say yes I committed malpractice, I'll pay 350 thousand and that's the end of it," says Michael Washington.  "But what happens to our life as a patient?"

Michael Washington says he was infected with Hepatitis B & C after getting treated at the Endoscopy center in 2007.

He wants the state law that puts a cap of pain and suffering damages removed so the doctors who infected him will be held accountable.

But he faces opposition from others in the medical community.

"I personally feel those doctors should be subject to criminal charges and it should not be related to the cap," says Dr. Jerry Jones of the Clark County Medical Society.

The Clark County Medical Society is worried that if the 350 thousand dollar cap is removed, doctors will have a tougher time getting malpractice insurance and may leave the state.

But attorneys with the endoscopy case say that's not the issue.

"It's not about insurance premiums," says Marni Rubin.  "It's about patients who suffer from negligence.  They're told their pain and suffering is only worth 350 thousand dollars."
